Officer sues restaurants following DUI-related crash

HUNTSVILLE, AL (WAFF) -

A Huntsville police officer filed a civil lawsuit against two restaurants whose employees are accused of serving alcohol to a driver involved in a crash.

Tonya Brooks faces an assault charge for the Sept. 2012 crash. It happened at the intersection of South Memorial Parkway and Lily Flagg Road in Huntsville.

Investigators said Brooks crashed into Charles Drapier's patrol car. Drapier had to be pulled from the cruiser. The lawsuit states Drapier suffered a traumatic brain injury in the crash.

The lawsuit names Chili's Grill & Bar on Carl T. Jones Drive and Applebee's Neighborhood Grill on South Memorial Parkway. According to the lawsuit, employees at either, or possibly both, restaurants served Brooks even though she was visibly intoxicated.

A trial date has not been set for the criminal charge against Brooks.
