Court date for exhumation hearing set for November

STEVENSON, AL (WAFF) -

A judge set a November hearing date to determine the exhumation of a woman buried in her front yard by her husband.

Some thought the hearing might be this week, but James Davis said he's been given nearly three weeks to figure out how he wants his wife's body removed.

Motions have been filed by the City of Stevenson asking that the remains of Patsy Davis be removed from the family home in the downtown area. James Davis buried her there as part of her dying wish, but the city sued and ultimately prevailed when the state Supreme Court upheld a judge's order that her body be removed.

The city's attorney has filed a motion for a hearing to determine how her body is to be removed, as well as to seek costs. The motion asks the judge to take the cost of removing her body and court fees from a $10,000 appeal bond made by Davis last year.

That court date has been set for Nov. 13 at 9 a.m.
