Control over DeKalb Co. cemetery at issue

DEKALB COUNTY, AL (WAFF) -

A DeKalb County cemetery owner plans to ask a judge to reconsider his decision on the future of a troubled cemetery that was taken over by the state. Against the recommendation of the state, Judge Shaunathan Bell ruled Rainsville Funeral Home would gain control over Mountain View Memory Gardens, located just outside the city of Fort Payne.

Officials at Cornerstone felt they should have gotten control of the facility. Not only had they the state's recommendation, but there are now concerns that victims of those pre-need contracts will become victims again because of the ruling.

Mountain View Memory Gardens has been under state control since 2009, after the previous owners were unable to fulfill their obligations for approximately 1,200 pre-need contracts.

In an August hearing, the state recommended to the judge to accept Cornerstone's offer to take over the cemetery. Cornerstone's offer included reimbursement of the cost of a marker in the pre-need contract when it became due with the death of a person who had a contract. This was not included in the offer by Rainsville Funeral Home.

The formal request for reconsideration was filed Monday with the court. No ruling or hearing date has been set.
