Motion filed to change venue in multiple murder case

One of the suspects in a two-state killing rampage wants his trial moved. Tuesday marks one year since the murders of six people in Alabama and Tennessee. Suspected killer Zakawanda Moss stood before a judge Monday.

Moss' trial is scheduled for Nov. 6, but a change of venue is one of several motions his attorney is arguing for before that trial. Moss walked into the courtroom shackled to sit and listen quietly as his attorney asked the judge to rule in their favor.

The first motion was for a change of venue. Moss' attorney presented 13 different articles from media on the news of the murders that spread all the way to Chattanooga. The judge is considering it, but said the only viable option could be busing jurors in from surrounding counties.

Investigators said Moss and another man committed the murders Oct. 22 2012, while searching two different homes for drugs and money.

In a perfect world, Moss' attorney said he would want to try the case all the way in Memphis for his client to get a fair trial. The defense believes because this case involves a lot of people – the families of six victims, including the daughter of a Fayetteville police officer – and that it has been widely reported that his client wouldn't get a fair trial.

Potential jurors hearing about the case is not enough to change the venue, if they can agree to be impartial and fair.

In another motion, Moss' attorney asked the judge to not allow a footprint expert to testify, claiming she cannot narrow down who made the footprints at the crime scene. The judge wants to wait until trial to determine if what the expert has to say is relevant or not.

In the meantime, the prosecution wanted to hear if a mental defense or an alibi was going to be thrown in before trial. The defense attorney said he doesn't have either.
