Informal hearing held over costs of burial appeals

STEVENSON, AL (WAFF) -

A Jackson County man appeared in an informal hearing Friday over his wife's final resting place.

James Davis said the hearing was at his request. Not much was accomplished, but the details could come out in a formal hearing as early as next week.

A letter from the state appeals court Friday gave the ruling that costs of the appeal will be charged to Davis, who lost his appeal in the state supreme court last week.

Attorneys for the City of Stevenson said they plan to ask the court to hold Davis' $10,000 appeal bond. In anticipation that the judge will continue with enforcement of the court's order, the attorney plans to ask that funds from that appeal bond be used to pay a funeral home to remove the body and place it in an appropriate cemetery or to have the remains cremated. They are also asking that court costs and costs incurred during the appeal also be paid to the court and the city.

If the judge agrees, any remaining money of the appeal bond could be returned to Davis.
