Birge pleads guilty to manslaughter in husband's death

LIMESTONE COUNTY, AL (WAFF) -

The woman known as the "Black Widow," charged with killing her husband in Limestone County, made a deal with the District Attorney Wednesday.

A jury convicted Kathy Birge for capital murder, but the state supreme court overturned that conviction. Birge was awaiting a second trial when she plead guilty to manslaughter.

The district attorney said they just didn't have the evidence needed to ensure a capital murder conviction. The state's high court overturned the original conviction because of issues with chain of custody in handling tissue and blood samples from victim Cecil Birge.

DA Brian Jones said with so much time gone since Cecil Birge's death in 2001, they would not be able to prove Kathy Birge poisoned her husband by drug overdose.

"We simply ended up with insufficient materials in which to get a capital murder conviction. We felt this was the best possible result we could get. She concedes she killed this man, and it's going to get some closure to the family," said Jones.

Kathy Birge's attorney, Patrick Hill, said his client is ready to get on with her life.

"She had a grandbaby born recently. She's lost family members. She's had her life put on hold, and she's going to be able to resume that now," said Hill.

Kathy Birge has been behind bars for twelve years. The judge sentenced her to time served. She will remain in prison because she previously pleaded guilty to forgery and theft regarding her husband's will and life insurance policy. She is eligible for parole.
