DECATUR, AL (WAFF) -

Sentencing was supposed to continue Monday morning in the Jordaan Creque trial, but instead the defense filed for a mistrial.

A jury found Creque guilty of three counts of capital Murder on Friday. He shot and killed two Krystal employees, Jeffrey Graff and Jesse Aguilar, during a robbery in 2011.

Over the weekend, a juror talked to Decatur Police Sergeant Rick Archer at a store. Sgt. Archer was a prosecution witness and worked the crime scene right after the Krystal double murders.

The defense asked for a mistrial, but after the judge interviewed both Archer and the juror, he determined that nothing was said that would compromise the outcome of the sentencing, and denied that motion.

In another development, the court recessed so the defense could go over some new evidence that the prosecution introduced. That evidence is phone calls that will somehow rebut evidence that a defense expert gave on Friday.

The defense also called a medical expert who gave Creque's history, and a person with a local Christian organization who testified to some of the classes he has taken while incarcerated.

Creque's step-father also took the stand Monday morning. He testified to a fight between Creque and his mother over bubble gum.

Creque later took the stand and apologized to the victims' families.

"I'm sorry for my actions and participating in such an event. I'm sorry to Mrs. Graff and Mrs. Aguliar for their loss," said Creque at his sentencing hearing. "I don't have any speech prepared. I know there's nothing I can say or personally do to bring relief or anything that would comfort you. You may not believe that what I'm saying is sincere but I'm honestly sorry for the lives that have been taken from you. I'm sorry. I am sorry to the jury for having you take time out of your lives to make these determinations."
