HUNTSVILLE, AL (WAFF) -

A civil trial against a Huntsville teen accused of causing a wreck that killed a small girl and injured several others has been put on hold for at least three months.

Gunner Scarano's attorney argued Friday that if the teen takes the stand during a civil trial he could incriminate himself and that would violate his constitutional rights.

Judge Bell ordered a three-month stay on the civil case and wants to see what happens with the District Attorney's office and any potential criminal charges before moving forward. Judge Bell said this is not a permanent stay and everything will be re-evaluated in January.

In May, Huntsville Police said a truck driven by Scarano caused multiple crashes and slammed into the back of a car, killing ten-year-old Jaden Coppens on Bailey Cove Road.

Scarano has not been charged, although court documents revealed a criminal investigation is ongoing.

During Friday's hearing, one attorney told the court Scarano's toxicology report has yet to come back.
