DNA evidence helps convict Burgess of murder

There are many stories of how people are cleared of crimes using DNA evidence.

On Friday, DNA evidence helped convict a killer.

Wesley Burgess was found guilty of the murder of Claysville business owner Ricky Moody.

Moody was stabbed 30 times and hit with a blunt object several times outside his business, Motors and Cash, in October 2009.

The case went cold until November 2010 when Sheriff Scott Walls announced they had a confession and an arrest.

Prosecutors went into this case without some key evidence and made their case beyond a reasonable doubt to the jury.

With DNA evidence, prosecutors said they were able to dispute Burgess' statements to law enforcement.

"This idea of two masked men out of nowhere with no reason to kill the defenseless victim, I think the jury saw through that story," said Marshall County District Attorney Steve Marshall. "The physical evidence disproved that claim and the fact that 18 months after the fact, the defendant was there and didn't do it, that story just didn't fly with the jury."

Burgess is expected to be sentenced Oct. 21. He faces up to life or 99 years and prosecutors say they'll seek
