Attorneys seek continuance in DeKalb capital murder trial

FORT PAYNE, AL (WAFF) -

Defense attorneys filed a motion Monday to continue the capital murder trial of Patty Westbrook.

She is accused of shooting Pete Batey, 70, to death after stealing his truck in a church parking lot in 2011.

The trial was to begin Monday in DeKalb County; she entered a plea of not guilty by reason of mental disease or defect.

Investigators said Westbrook stole Batey's truck in a Geraldine church parking lot and shot him.
