Man continues fight to keep wife buried in yard

STEVENSON, AL (WAFF) -

A Jackson County man hopes the Alabama Supreme Court will soon take up his civil case. He buried his wife in the front yard of his home, but the city said she can't stay there. It has been months since the case was first appealed, but James Davis said he's over 70 now and would like to see a resolution, should his health begin to decline.

Davis has been sprucing up around his house in downtown Stevenson, including his wife's grave in the front yard. He buried his wife Patsy in 2009, despite objections from the city council. The city sued, and a circuit judge ruled that he must remove her remains.

Davis and his attorney have appealed that decision, maintaining that the city never adopted regulations regarding cemeteries. Davis said he's now looking for justice to come from the state's highest court. "I'm starting to wonder if the law is for me, or for what's right, because I know I'm 100% right. I went through everything that I was told to do," he said.

He went on to say that he is not worried about making sure the family burial plot is taken care of after he's gone; he has several children and grandchildren who plan to take the house and care for things.
