Mistrial in Marshall Co. gang rape case

GUNTERSVILLE, AL (WAFF) -

A judge declared a mistrial in a Marshall County gang rape case.

Opening statements were scheduled to begin Wednesday. A judge declared the mistrial after new information was presented that should have been released during the discovery process.

According to police, Trey Maurice Avery and Brockton Hunter Logan were among a group of young men who picked up two girls in Boaz then drove them to a home on Anderson Street in Guntersville. That's where authorities said one of the girls was raped the night of December 18, 2010.

Police said the two girls were left stranded on Wiggs Street where they called for help.

Avery and Logan were charged with first degree rape. Three others were also charged, two were 16 at the time the other 15.
