Marshall Co. man pleads not guilty to home repair fraud

A Marshall County man has pleaded not guilty to home repair fraud. The victim in the case is a woman whose home was damaged in the 2011 tornadoes.

The woman paid a man $5,000 to install more than 20 windows. The work wasn't completed, the money that was paid is gone.

Phil Harvey Chastain, Jr. pleaded not guilty this week to charges of home repair fraud in relation to work left incomplete at a home on Mann Avenue in Boaz. Lisa Freeman said her home was damaged in the April 2011 tornado and then again by a storm a short time later.

Freeman said she hired Chastain to do the window work and paid him $5,000 for the job. As time passed, Freeman said Chastain only gave her lip service as to when the work would be completed. When she finally asked for her money back, Freeman said he told her the money was gone. She said it's been a costly learning experience.

"I would not have hired him," Freeman said. "I would have done some checking. But I had no reason not to trust him. I thought I knew his family. I didn't really know him all that well, but I knew he had a construction company in Birmingham and he seemed legit."

A trial date for Chastain has not been set.
