Fate of DeKalb Co. cemetery in hands of judge

DEKALB COUNTY, AL (WAFF) -

The fate of a failed DeKalb County cemetery currently run by the state could soon be in the hands of a judge.

Testimony was underway Tuesday, concerning the Mountain View Memory Gardens cemetery located just outside of Ft. Payne.

Nearly 1,200 contracts were not honored when the cemetery went into receivership. Now, two funeral homes are making offers to take it over.

Mountain View Memory Gardens went into receivership back in June 2009.

A DeKalb County judge heard testimony from Billy Dalton of Cornerstone Funeral Home and Kerry Chandler of Rainsville Funeral Home. Both men are making offers to take over the cemetery, it's upkeep, and fulfill the nearly 1,200 contracts for burial services that were not honored.

In early 2010, more than 160 people filed claims against the cemetery for failing to honor prepaid burial arrangements.

A state Department of Insurance representative recommended to the court to accept Cornerstone's offer. That decision will be left up to a judge.

    Four people were killed, and 4 others were injured in a shooting inside a Waffle House at 3571 Murfreesboro Pike. The shooting took place at approximately 3:30 a.m. Sunday. According to police at the scene, a white man who was naked except for a green jacket went into the restaurant and started firing. They described the gun he used as an AR-15. Police are still searching for him at this time.
