Trial underway for man charged with murdering son

MARSHALL COUNTY, AL (WAFF) -

A jury is now in place to hear the case of a Marshall County man charged with murdering his own son.

A jury of six men and seven women were selected around 2 p.m. Tuesday. The judge gave the jury some initial instructions before recessing for the day.

J.C. Franklin Samuels, 63, is now on trial for the murder of 35-year-old Gregory Allen Samuels. Guntersville Police said Samuels shot his son in the yard of their Robert Circle home in September 2009.

Police believe the incident was a domestic situation that escalated when Gregory went to go get more beer. When he returned, Gregory was shot in the yard with a .22 caliber rifle a single time in the chest.

Gregory had been living with his father for about a month when the shooting took place. During that time police were called at least three times to the home for domestic calls.

Opening statements begin at 9 a.m. Wednesday.
