Trial underway for man accused of trying to kill HPD officers

HUNTSVILLE, AL (WAFF) -

The trial for a Huntsville man accused of trying to shoot two police officers is underway.

Samuel Ward said nothing to reporters as he walked into the Madison County Courthouse. Ward is charged with two counts of attempted murder stemming from the December 2011 shooting.

Both Huntsville Police officers testified they were following up on a call from earlier in the morning when they came across Ward's vehicle in a parking lot off Indiana Street.

The officers said they smelled marijuana coming from Ward's vehicle, went to investigate, noticed a marijuana cigarette, asked Ward to exit the vehicle, and a fight ensued. During the altercation, both officers said Ward became combative and pulled out a gun and fired. The officers returned fire and hit Ward at least five times.

Ward's attorneys argued he never meant to kill the officers because he passed up an opportunity to shoot when he was at point-blank range and only fired one shot. 

Prosecutors said they have video and audio of the entire shooting scene but have not presented it in court.

Earlier this year, Ward was found guilty of assaulting a Huntsville Police officer in 2010 and sentenced to 20-years behind bars.

His attempted murder trial is expected to pick up again, Tuesday at 9 a.m.
