Man convicted of sex crimes headed back to court

A Jackson County man convicted of sex crimes against a child will have to be tried again.

A judge has vacated the sodomy and child enticement convictions against Mack Anthony Allen.

Claims were made that Allen had ineffective counsel at trial. The judge agreed and now Allen is getting a new trial after several years behind bars.

Allen was taken out of a state prison and is now back in the Jackson County Jail.

Allen pleaded guilty to sodomy and child enticement charges and received a 15-year sentence and another ten-year sentence to run concurrent with that.

Allen sought a new trial arguing he was not told that he would not receive good time for his sentence.

In the order, the judge found that his trial counsel did not inform him he had to serve 85-percent of that sentence with no chance of time off for good behavior. The order shows Allen would not have agreed to the plea deal if he knew that.

His attorney admitted he doesn't remember if he told Allen that detail or not.

Allen is being held without bond pending an initial court hearing.
