Judge hears lawsuit against revenue commissioner

Allegations of political corruption involving Marshall County's revenue commissioner are at the heart of a lawsuit that was heard Wednesday afternoon.

A Marshall County resident filed the lawsuit.

Attorneys on both sides began arguing the case of Kenneth Downs versus Joey Masters, the Marshall County Commission, and an insurance company.

The suit claims the taxpayers of Marshall County have been defrauded of up to $20 million by Masters because he lowered property values for wealthy friends and political supporters which lowered their taxes due.

The suit maintains that caused lower revenues for county agencies which resulted in less services for residents.

Defense attorneys maintain state law does not allow for recovery of such funds by any private individual, that recovery must come through the government or the attorney general.

The judge is expected to issue an order on how the case can proceed in the next 14 days.
