GRANT, AL (WAFF) -

A former police officer in Marshall County is waiting to hear if his suit against the city for wrongful termination will continue.

The city of Grant is asking the judge to toss out the case but the former officer's attorney maintains it's a suit with merit and deserves to proceed.

Rodney Charles Van Etten filed suit against the Grant Police Department and the mayor last year.

Van Etten claims he worked with a former chief to video tape alleged wrongdoings by, then officer, Roger Hornbuckle, which led to Hornbuckle's resignation in 2004. But Hornbuckle returned to the department some time later and was named chief.

Van Etten claims Hornbuckle then worked to have him and several others removed.

The city claimed in court, Van Etten wasn't patrolling where he said he was, which Van Etten denies claiming he was often on foot patrol.

The judge said he planned to put out an order in the next 48 hours if the case would be allowed to continue.
