JACKSON COUNTY, AL (WAFF) -

A former Jackson County commissioner is taking his case against the local legislative delegation to court.

He's challenging the way TVA tax revenues are disbursed.

Former commissioner Horace Clemmons and the attorneys met for the first time with a special appointed judge Monday morning after the local judges recused themselves from the case.

Clemmons expressed concern over how TVA funds were being distributed while on the commission. But after his term was over he took action by filing suit against the legislative delegation comprised of Senator Shadrack McGill and Representatives Wayne Johnson and John Robinson.

"And it questions the constitutionality of local legislators being able to give the money away almost at will or a committee of which they are at least half of the membership having that authority to do so," said Clemmon's attorney, Julian Butler.

They are seeking a judge's ruling in the case but no word on when that may happen.
