Judge denies Desmonte Leonard's request to return to crime scene

AUBURN, AL (WSFA) -

A judge has denied Desmonte Leonard's request to return to the scene of last year's apartment shooting for investigative purposes.

Lee County Circuit Judge Jacob Walker denied the defense's motion to allow Leonard to return to the scene of the crime to "jog his memory" of the events that left three men dead, three injured and Leonard on the run from law enforcement. 

Judge Walker wrote in his opinion that transporting Leonard to the scene is a safety risk, the apartment complex is privately owned property no longer controlled as state evidence, and the court would not be able to seal Leonard off from the public while on the scene which would possibly compromise a potential jury.

The defense argued at a hearing back in May that allowing Leonard to return to the complex with his attorneys was critical to the case.

Judge Walker wrote that Leonard has previously been a flight risk and was being held without bond pursuant to a capital murder charge. Walker denied the order on the basis that he believes the use of modern technology will be sufficient to recreate the crime scene.
