Defense moves to have case tossed in Limestone County murder

ATHENS, AL (WAFF) -

The defense has filed a motion requesting a judge dismiss the capital murder indictment against Joel Moyers.

Moyers remains in the Limestone County jail without bond. He's accused of shooting and killing Brandon Hydrick in September 2012 in Tanner.

A judge dismissed the first capital murder indictment against Moyers because of wording in the indictment.

Prosecutors moved to re-indict Moyers. A Limestone County grand jury handed down a new capital murder indictment in June.

The defense filed a motion stating the grand jury that returned the most recent indictment was improperly convened.

The motion also states the district attorney has "made himself an essential witness" and could be called to testify.

The Limestone County Assistant District Attorney filed a response stating the defense arguments are without merit. 

A judge has not ruled on the defense motion.
