In Marshall County, justice delayed could be a case of justice denied.

It's been nearly six years since a city judge, some high-ranking firemen, and retired business owners were cited for illegal hunting and the case still has yet to go before a judge.

It was 2007 when Albertville District Judge Dee Walker was cited for hunting over bait at a dove shoot just outside of Albertville.

He along with 15 others are still on the docket awaiting trial which normally is held three to six months after the citation is issued. State conservation officers claim the group was using corn as bait.

Hanson said all of his clients are pleading not guilty to the incident at the farm. He said there were cultivated fields and cattle on the farm and that everyone followed the law while on the hunt.

But judges and prosecutors have recused themselves over the years. 

The Alabama Attorney General's Office has named two prosecutors to handle the case over the years and there have been numerous continuances. One judge specially set the cases for trial but he was later appointed to a state judgeship.

And the case doesn't look to be resolved soon. The most recent prosecutor with the A.G.'s office withdrew from the case last month after taking another job, setting the case back further as they must now reassign a new prosecutor.

The fine if convicted is $25. If they are convicted, Hanson said his clients plan to appeal to Circuit Court.
