Farmer appeals case against city of Guntersville

GUNTERSVILLE, AL (WAFF) -

A Guntersville farmer arrested at a farmers market is appealing his case against the city to the 11th Circuit Court. Vesta Noles lost his case with a federal judge in Birmingham.

The case was filed last year after Noles was arrested by Guntersville Police at a farmers market. Noles was asked to leave when city officials said he failed to allow verification that his produce was farm raised and not resold produce.

Noles sued, saying he had paid for his stall at the market and had a right to be there.

In April, a Birmingham federal judge dismissed the federal claims and sent the remainder of the suit back to circuit court. Since that time, Noles has now appealed his case to the higher federal court.

At this time it's not known when or if the 11th Circuit will hear the case.
