AL Board of Education delays failing schools list

HUNTSVILLE, AL (WAFF) -

The Alabama State Board of Education will meet Thursday in Montgomery, however they will not publicly announce the "failing schools" list, which is on hold until next week.

State Superintendent Dr. Tommy Bice says they are still addressing a "legal inquiry" on the Accountability Act, so the highly anticipated list will not be released until Tuesday.

It is not clear what that inquiry entails. However, the Department of Justice has contacted Dr. Bice about the Accountability Act. They are asking about a provision of the law which says schools do not have to accept a student who wants to move from a failing school.

The Act lets parents receive tax credits if they move their child from a so-called "failing school" into a non-failing one. As of Wednesday, Alabama Board of Education leaders are now calling them "priority schools" instead of "failing" ones.
