MARSHALL COUNTY, AL (WAFF) -

Charged with assault second, William Todd Epps entered a blind plea Wednesday morning to assault in the third degree.

The charges stem from an incident on January 16, 2011 at a party at Colony Apartments in Albertville.

Prosecutors contend Epps came out of the apartment to a breezeway where he met Jesse Driskill.

They claim Epps hit the victim so hard it knocked him out, that's when his unconscious body fell to the concrete. He hit his head on impact causing a train injury and was rushed to the hospital for surgery, that's where he woke up.

Epps is expected to be sentenced July 2nd.
