Lawsuit filed in deadly multi-vehicle wreck

HUNTSVILLE, AL (WAFF) -

Two people involved in a deadly multi-vehicle wreck last week filed a lawsuit Tuesday against the teen driver police say caused the wreck, and the teen's father.

The crash happened last Tuesday at the intersection of Bailey Cove and Weatherly Road in South Huntsville.

Police say 18-year-old Gunner Scarano hit a van and caused a chain reaction. 

According to the suit, the van hit the vehicle Amy Creech and Bailey Douglas were in. It also claims Scarano's truck then hit Creech's vehicle on the passenger side.

"Everybody is listening to this story, the folks that were involved that witnessed it and everybody wants to know what happened," said Jeremiah Hodges, he is representing Creech and Douglas.  "Everybody wants to know what was going on with this young man and filing suit is one way to try and get that information. Otherwise, we are forced to seek information from an insurance company that doesn't want to give us information."

The plaintiffs claim Scarano was driving at a high rate of speed and failed to slow down.

"If the 18-year-old was negligent then there is a claim to be filed against him for negligence," said Hodges.  "If the young man did or didn't do something he should or shouldn't have done, if he was affected or influenced by drugs or alcohol or a medical condition or whatever the facts may be that's his issue."

According to court documents, Creech and Douglas suffered severe personal injuries.

The plaintiffs name Scarano's father, Richard, in the suit, claiming he negligently entrusted his son with the vehicle.

"The negligent entrustment part of the case that's filed against who we believe to be the father, that's really more of an issue if the 18-year-old shouldn't have been allowed or shouldn't have been placed in a position where he was negligent where he was driving," said Hodges. 

They're seeking compensation for medical bills and property damage.

"In every civil action where there is an accident involved the plaintiff's lawyer will sue for compensatory damages: their out of pocket expenses, medical bills, pain and suffering but they generally also sue for punitive damages," said Attorney Mark McDaniel.  "Those are damages awarded by a jury to punish to send a message to the community."

No charges have been filed against Gunner at this time.

Police did take Scarano's blood for testing. They are still waiting on the results.
