Murder suspect asks judge to dismiss indictment

ATHENS, AL (WAFF) -

The Limestone County man accused of shooting a killing a man last fall filed a motion asking the judge to dismiss one count of the four count indictment.

Investigators say Moyhers shot and killed Brandon Hydrick in September 2012.

Joel Moyers is charged with capital murder, murder extreme indifference, and two counts of shooting a firearm into an occupied automobile.

According to the motion the state has not met the burden proving Moyers intentionally murdered Hydrick. The motion requests the dismissal of the capital murder indictment.

Moyers remains in the Limestone County jail without bond.

The motion also states that because the capital murder indictment should be dismissed Moyers is being held against his will.

The judge has not ruled on the motion.

Moyers will go to trial June 10.
