Wrongful death lawsuit filed following fatal wheelchair accident

DECATUR, AL (WAFF) -

Loved ones of a woman who died following a wheelchair accident at a Decatur assisted living facility have filed a wrongful death lawsuit.

Elizabeth Street, 94, ended up in a water-filled ditch during a fire drill at Country Cottage Assisted Living. Investigators say Street rolled down a hill in her wheelchair.

Street spent three days in the hospital. Court documents state she died of aspiration pneumonia on October 28, 2012.

The wrongful death lawsuit states an unknown employee rolled Street to the outside of the facility and left her in a hazardous location.

The plaintiffs have requested a jury trial. 

Decatur Police opened an investigation into the accident. The results of the investigation are unknown at this time.

    A ground search ensued that lasted about four hours and covered approximately six miles, ending a few hundred yards east of Hays Mill Road where the suspects were caught in a hunting stand/shoot house.
