GUNTERSVILLE, AL (WAFF) -

A Guntersville man kicked out of the local farmers market last year is now watching some of his lawsuit he filed against the city get kicked out of court.

When the case was filed in circuit court, the city opted to deal with the federal issues in federal court. The federal court ruled in the city's favor, so the remaining issues will be handled locally in circuit court.

A federal judge has dismissed claims by Vesta Noles, and the case was sent back to Marshall County and filed in the court on Monday.

Noles sued the city after he was kicked out of the local farmers' market last summer when market officials could not verify the produce he was selling was locally grown.

Since that time, the city has decided to allow produce for resale provided resellers clearly post that their goods are not locally grown and pay a full business license fee as well as pay sales tax.

Since the market recently opened, Noles has not been back.

"He was one of my favorite customers, I mean, my favorite people to trade with, and I hate it that he's not here no more," said customer Gisela Jordan.
