MARSHALL COUNTY, AL (WAFF) -

A $12-million lawsuit was filed against Marshall County.

Attorneys said they have issues with how the commission handled serious problems in the county's revenue office.

The audit claims the revenue commissioner gave some property tax breaks he should not have, which cost the county money it desperately needs.

Through an attorney, Kenneth Downs of Grant filed the claim on Tuesday.

It states Revenue Commissioner Joey Masters reduced property taxes for friends, political supporters, allies, and wealthy individuals for a three year period from 2008 to 2010.

While state revenue commission officials have said they are only assisting the local revenue office since the audit, the claim states Masters has been removed from his duties for illegal activities, and the commission has banned him from the courthouse.

Commission Attorney Clint Maze said they plan to ask a judge to dismiss the claim.

Maze claims Downs does not have standing to show specific damages, also noting the commission has no authority over the revenue commissioner's office.
