Judge grants double murder suspect's request for bond hearing

HUNTSVILLE, AL (WAFF) -

A Madison County judge granted a request for a bond hearing for a man accused of killing his wife and son.

Stephen Marc Stone faces two counts of capital murder.

He is accused of strangling his wife Krista and strangling and drowning his 7-year-old son Zachary. Police found their bodies in the family's home on Chicamauga Trail on February 24.

Stone is currently in the Huntsville-Madison County Metro Jail without bond.

The motion filed in Madison County District Court states Stone can only be denied bail if he is likely guilty and will likely be punished by death.

Defense attorneys also filed a motion requesting the District Attorney to determine if the State will seek the death penalty.

A hearing date has not been set. An order issued by the judge states the hearing will be set on the next available docket.

Stone has a preliminary hearing set for May 1.
