Court overturns conviction in Amber Alert hoax murder

GADSDEN, AL (WAFF) -

Alabama's Court of Criminal Appeals has overturned Kevin Towles murder conviction.

Towles had been sentenced to death for the 2006 death of Geontae Glass.

The little boy had been reported missing from a gas station in Marshall County. He was later found dead in a car trunk in Etowah County several days after his mother, Shalinda Glass, reported him missing. 

Shalinda Glass and Towles were arrested.

The court overturned Towles' conviction because they felt that testimony at trial by another child who claimed Towles beat him was prejudicial.

Towles was granted a new trial by the Alabama Court of Criminal Appeals.

The appellate court ruled testimony by Towles' son, Shaquille Cameron, was improper.

Cameron testified that while he was 8 or 9, Towles struck him in the head with a metal box fan because he left cups under his bed.

Cameron also testified Towles had struck him with things such as a belt, extension cord, and a broomstick.

The defense appealed claiming such incidents happened three years before Geontae's death and cited the sole purpose of the testimony was to claim Towles had a bad character.

"Well, obviously, a lot of time and effort went into the trial of this case, and we're disappointed that the court of criminal appeals ruled as it did, but we certainly respect any ruling that comes from the court.  We've asked the Alabama Supreme Court to review their ruling," said Etowah County District Attorney, Jimmy Harp.

Harp said the state plans to ask for an immediate reconsideration of the ruling.

It still may have to go to the Alabama Supreme Court.

Harp said if they have to try it, they will be prepared.
