LAWRENCE COUNTY, AL (WAFF) -

The trial for the man charged with killing an elderly couple in Town Creek starts in 10 days.

On Friday, Charles Moore's defense team worked to get evidence thrown out.

Defense attorneys for Charlie Moore argued three motions for suppression. Two involving evidence seized by investigators, including at Moore's home. The third concerns the statement Moore gave to investigators just hours after the bodies of Bailey and Betty Nichols were found inside their home in Town Creek.

Moore's defense claims investigators did not have probable cause for the searches.

Authorities said they discovered a 32 caliber handgun, along with Bailey Nichols' wallet and keys.

The judge will decide on the motions next week.

Fellow church members found the elderly couple's bodies after becoming concerned because they missed a service in December of 2009.

The district attorney will seek the death penalty in this case.

Jury selection is set to start on April 8.

Lawrence County Judge Mark Craig knew the victims, so he recused himself from the case. A judge from Winston County will oversee the trial.
