Ala car dealer charged with mistreating guardsman

Posted: Updated:

BIRMINGHAM, Ala. (AP) - A north Alabama car dealer is charged with mistreating a National Guard member in a vehicle deal.

Federal prosecutors in Birmingham say 74-year-old Carl Ralph Nuss of Cullman was indicted on two counts of violating a federal law which mandates breaks for service members who are called to active duty.

Authorities say a 22-year-old service member bought a Ford Sport-Trac from Nuss in 2011 and was later called to active duty in Afghanistan. They say the Guardsman requested a reduction in his 25% annual interest charge, but Nuss refused.

Prosecutors say the dealer then hired two men who repossessed the $9,700 vehicle.

Nuss says he hasn't done anything wrong and isn't guilty.

The dealer says the guardsman's family is just trying to get out of paying for a vehicle.
