OPELIKA, AL (WSFA) -
After numerous attempts to have his trial moved away from Opelika and nearby Auburn University, the man accused of poisoning the University's famed Toomers Corner oak trees is getting his wish.
Wednesday, Harvey Updyke's attorney confirmed that the trial will be moved to Elmore County after a change of venue was granted.
Updyke's legal advisors have long stated that he cannot get a fair trial in Opelika because of its close association with Auburn University.
Attorney Andrew Stanley said a trial date is set for April 8.
