Woman arrested on capital murder charge

BIRMINGHAM, AL (WBRC) -

The Etowah County Sheriff's Office says they have arrested an Attalla woman on a capital murder charge. Margie Morgan Kelley, 38, faces one count of capital murder in connection to the disappearance of two males in December of 2009.

Margie Morgan Kelley's husband, Robert Wayne Kelley, pleaded guilty to two counts of capital murder and abuse of a corpse in the deaths of James Bachelor, 38, and Rocky Morgan, 55. He entered his guilty plea on Thursday, Feb. 28, 2013, the same day that his wife was arrested on a capital murder charge. His sentencing is set for April 24, 2013.

Margie Morgan Kelley originally was charged with hindering prosecution in the case, but investigators say newly discovered evidence led to Kelly's arrest.

"Throughout the past 90 days leading up to trial, investigators and prosecutors from the District Attorney's Office and investigators with the Etowah County Sheriff's Office discovered additional evidence as witnesses were interviewed that led to Margie Kelley's arrest," the Sheriff's Office said in a press release.

The victims in the case, Bachelor and Morgan, were last seen alive on Dec. 2, 2009. Investigators found pieces of human remains a couple weeks later, on Dec. 16, 2009.

The new evidence led them to upgrade Margie Kelley's charges to murder. The Sheriff's Office says they cannot give specific details about the new evidence due to the ongoing investigation.

Both suspects are being held in the Etowah County Jail without bond.

    The Guntersville Police Department have released news details on a double shooting late Friday afternoon that left one man dead.

    The incident occurred at approximately 5:30 p.m., when police from multiple law enforcement agencies responded to a 911 call reporting two people had been shot on Edmonds Road.
