Witnesses testify in reckless manslaughter case

JACKSON COUNTY, AL (WAFF) -

Day two in the trial for a Jackson County man charged with manslaughter in a car race accident was a relatively short day of testimony.

One of the prosecution's witnesses was unable to show, but they were able to get in three witnesses before breaking around lunch time.

Prosecutors resumed putting on witnesses in their case against 30-year-old Franklin Delano Mullens of Scottsboro, who is charged with reckless manslaughter.

Prosecutors contend his actions while racing led to the death of 53-year-old Thomas Glenn Frazier of Pinson.

Mullens and 40-year-old Dewayne Pittman were racing their Ford mustangs in the northbound lane of Highway 79 just south of Scottsboro on July 8, 2011.

Mullens pulled ahead of Pittman, but prosecutors believe Pittman missed his shift and lost control into the southbound lane, hitting Frazier's Chevy truck.

Both Frazier and Pittman died.

The defense admits Mullens was speeding and racing, but his vehicle did not touch either of the other vehicles and did not cause the wreck.

Prosecutors are expected to resume their case Wednesday morning with an expert witness.
