JACKSON COUNTY, AL (WAFF) -

A Jackson county man is on trial for manslaughter.

Franklin Delano Mullens, 30 of Scottsboro, is on trial for the deaths of two people killed while he was racing on the highway with one of the victims. He is facing a reckless manslaughter charge.

Prosecutors said his actions contributed to the death of an innocent man, but the defense disagrees.

Trial got underway Monday afternoon for Mullens.

He is charged in the death of 53-year-old Thomas Glenn Frazier, of Pinson.

Prosecutors argued Mullens and 40-year-old Dewayne Pittman were racing their Ford mustangs on Highway 79 just south of Scottsboro when the accident happened on July 8, 2011.

Frazier was traveling south in his Chevy truck when Pittman lost control of his mustang and collided with Frazier on the Mink Creek Causeway.

Prosecutors argued it was the racer's actions that resulted in the death of Frazier, but the defense contends that Mullens had passed Pittman and his vehicle never touched either of the other vehicles nor did it cause one vehicle to collide into the other.

Prosecutors began putting on their witnesses on Monday afternoon. The first was Frazier's widow.

Testimony will continue.
