ATHENS, AL (WAFF) -
Court documents filed in Limestone County Circuit Court reveal the State of Alabama does not intend to seek the death penalty against Joel Moyers.
Moyers is charged with the capital murder of Brandon Hydrick.
Hydrick was shot and killed in Tanner in September 2012.
Moyers was initially charged with murder, but the charges were upgraded to capital murder with the grand jury indictment. His bond was revoked with that indictment.
Moyers spent several days in the hospital the indictment. He overdosed after learning of the capital murder charge.
A hearing is set for February 19 to go over motions in this case. That hearing will take place at the Limestone County Courthouse in Athens.
