Judge denies recusal request in Lindsey Lowe case

Attorneys for the Hendersonville woman accused of smothering her newborn twins to death in September 2011 say a different judge needs to hear her case.

Lindsey Lowe appeared in court Tuesday to ask Judge Dee Gay to recuse himself, but Gay denied the recusal request and called the arguments ridiculous.

Lowe's attorney had claimed Gay called one of his motions "sloppy" and said the judge was rude to a defense witness.

In his ruling, Gay said there was no way any of his comments could be attributed to anything more than being a human judge asking human questions.

"It was nothing personal against the defendant, nothing personal," Gay said. "I was just commenting on what I thought was an inadequate motion."

"Judges are not robots," Gay continued. "Attorneys should not mistake emotions in a judge's ruling with allowing an emotion to control the judge's application of the law."

Lowe's father made several strong statements claiming the judge was biased, but those were written statements sealed by the judge.
