TUSCUMBIA, AL (WAFF) -
A Colbert County grand jury handed down a new indictment against a man already charged with capital murder.
Derek Burt now faces five counts of capital murder and three counts of criminal solicitation.
The most recent indictment involves the criminal solicitation investigation.
Investigators say Burt shot and killed Harry Ricks in Colbert County in 2008. According to deputies he also tied up Ricks' family during the home invasion. Ricks' managed to get free and that when he was shot.
Colbert County Investigators say while in jail, Burt tried to mail a letter to someone asking them to kill two members of the Ricks' family. That letter was intercepted at the Colbert County Jail.
Burt will be arraigned on the criminal solicitation charges on February 12. A status conference for the capital murder case is scheduled for February 20.
