A jury in Selma has convicted a man of capital murder for a drive-by shooting that killed a 3-year-old boy. The jury returned the verdict Tuesday evening against Johnny Lee Dukes.
District Attorney Michael Jackson said Circuit Judge Jack Meigs sentenced Dukes to life in prison without parole because the family of 3-year-old Rosjah Butler had asked that Dukes not receive the death penalty.
Jackson said 13 shots were fired from a car at a Selma home on April 27, 2010, in retaliation for a group being sold bad drugs.
Prosecutors described Dukes as a passenger. The man accused of being the driver is scheduled to go on trial in the new year.
Jackson said the conviction sends a message that drive-by shootings will not be tolerated in Dallas County.
