HUNTSVILLE, AL (WAFF) -

The United States Department of Education Office for Civil Rights is investigating the Huntsville City School district over harassment claims involving a JROTC student at Grissom High School.

The letter, dated November 21st, 2012, was sent to James Robinson, Executive Director of the GLBT Advocacy & Youth Services.  In the letter it states that the Office for Civil Rights is a neutral fact finder and that an attorney/investigator from Atlanta will be talking to all parties involved.

Robinson filed the complaint on behalf of the student in October of this year and spoke to the Office for Civil Rights. The allegations brought forth relate to an incident in April of this year when a JROTC teacher is claimed to have made comments about the Bible and homosexuality.

In the letter, Robinson accuses the Huntsville School District of "failing to respond and take action reasonably calculated to stop the harassment, prevent its recurrence, and remedy the effect of the harassment." He also accuses the district of "retaliating against the student after she complained about the comments by failing to respond and take action reasonably calculated to stop peer bullying."

Huntsville City Schools released the following statement:

"Huntsville City Schools received a letter this week from the U.S. Department of Education, Office of Civil Rights, of its intentions to investigate a complaint. The letter notes that the investigation "in no way implies that OCR has made a determination with regard to their merits", and that the "OCR is a neutral fact-finder" in analyzing the complaint. The district will work with the OCR to provide any assistance to assure a prompt resolution."
