TUSCUMBIA, AL (WAFF) -
The case against a murder suspect accused of trying to hire someone to kill the surviving witnesses will go to a Colbert County grand jury.
Derek Burt is charged with five counts of capital murder in the 2008 shooting death of Harry Ricks. Investigators say he tied up Ricks' family during a home invasion. Ricks' managed to get free and that's when he was shot.
Colbert County Investigators say Burt tried to mail a letter to someone asking them to kill two members of the Ricks' family. That letter was intercepted at the Colbert County jail.
Burt is also charged with solicitation of murder.
Burt will be arraigned on the murder charges December 11 at the Colbert County Courthouse in Tuscumbia.
