Attorney wants capital murder trial delayed

FORT PAYNE, AL (WAFF) -

Attorneys for capital murder suspect, Patty Westbrook, filed a motion in DeKalb County Circuit Court asking the judge to delay the trial.

Westbrook is accused of shooting 70-year-old Pete Batey in a church parking lot in Geraldine in March of 2011.

Investigators say she stole Batey's vehicle and was arrested a short time later in Guntersville.

Westbrook's attorney says he will not be ready for trial in time for the December 10 trial date. The motion for a continuance states Westbrook is experiencing extreme mental deficiencies and is not competent to assist in her defense.

A judge has not yet ruled on that motion.
