HUNTSVILLE, AL (WAFF) -
A Madison County judge has ordered a hearing in the civil lawsuit filed after an accident at a Huntsville air show.
A summary judgement hearing is scheduled for January 4, 2013. During this hearing the judge could make a decision about the future of this case.
5-year-old Josiah Miller died when equipment fell on him during a micro-burst at the 2008 air show.
The child's family filed a lawsuit against the Airport Authority and All Needz Rental Company.
This case is set to go before a jury this February.
