ALBERTVILLE, AL (WAFF) -

The grandmother of the toddler who died Wednesday afternoon after being run over by an SUV, has been charged with homicide in connection with the incident.

Investigators said 52-year-old Rebecca Jane Elrod of Mt. Olive Road in Albertville, was driving the Ford Explorer when she ran over 2-year-old Brayden Lucas Daniel at 3:29 p.m. on Diane Avenue. Elrod was under the influence of prescription medication at the time of the accident, according to investigators.

Elrod was taken into custody at the scene for driving under the influence and transported to a local hospital where blood was drawn under a court order.

A background check revealed Elrod had three other arrests for driving under the influence. All three times, the charges were dropped.

Court records show state troopers arrested Elrod for DUI in august of 2011. The trooper's report stated she was driving under the combined influence of alcohol and a controlled substance.

In June, 2012, the charge was dropped, with conditions. Court records did not explain those conditions. Albertville city officials confirmed she had DUI arrests in 2003 and 2007. The 2003 charge was dropped after Elrod attended a court referred program. In 2007, she attended a more intensive court referred program, and, once again, the charges were dropped.

Elrod was booked into the Albertville City Jail on DUI charges Wednesday. She was charged with criminally negligent homicide Friday and released on a $2,500 bond.
