City council race results to be determined by provisional ballots

Provisional ballots will determine a very tight city council race in Guntersville.

Provisional ballots are ballots of people who were denied the right to cast a ballot because of issues.

Now, it's up to the board of registrars to decide how many of the six provisional ballots are legitimate.

Former Councilman Sam Stewart and fellow District 1 candidate Charles Avery will have to wait after the men tied at 62 votes each at the polls on Tuesday.

Both men received the exact same votes at the polls, but Stewart edged Avery four to one in the absentee vote.

The board of registrars is trying to determine the validity of six provisional votes of those people denied the ability to cast a ballot at the polls.

Board Chairman Don Milligan said that can happen when people come to the polls and they're not on the voters list or if they fail to bring identification to the polls.

It's up to the board to determine voter eligibility.

"We go to the list to find out if they are actually at that address, if they live at that address, if they're registered at that address.  We try to determine why they're not on the list," said Milligan.

Milligan said they plan to present their findings to the city Monday morning.

The council will determine the winner at their council meeting that evening.
