FYFFE, AL (WAFF) -

A wild new political fight is headed for court in the DeKalb County town of Fyffe.

A town councilman is accused of threatening a neighbor in an argument over a campaign yard sign.

A Fyffe resident said he went to keep a councilman from bullying a neighbor, but instead he got bullied.

Last week, Curt Winkler said he went to confront Councilman Dale Wooten, who was at his neighbor's home putting up campaign signs.

Winkler said the neighbor had told him for months there was no way he would vote for Wooten and was concerned the elderly neighbor was being taken advantage of.

Winkler said he asked his neighbor if he was ok but that Wooten repeatedly interrupted him - leading to a full blown argument.

Wooten maintains Winkler used a lot of profanity and stuck his finger within an inch of his face.

But Winkler said that's when the councilman threatened him with a gun - a claim Wooten emphatically denies.

"I don't think a city council member has the right to threaten to shoot somebody.  As far as I know, this is still the United States and I do have freedom of speech," said Winkler.

"I never said I would shoot him.  I said I had a permit to protect myself if he assaulted me.  That's all I said," said Wooten.

Both men sought police reports and sought to file charges.  A DeKalb County judge has summoned both men to court where the issue will be addressed.

Winkler said both men are due back in court September 5.
